Forensic Vocational Evaluation

Workers' Comp

Long-Term Disability

A forensic vocational evaluation is a comprehensive, independent assessment of a claimant’s vocational history, transferable skills, functional limitations, and return-to-work potential. It forms the evidentiary basis for employability determinations in litigated matters.

Our evaluations follow standardized methodology established by the American Board of Vocational Experts and California case law criteria. We review all available medical, employment, and educational records, conduct a structured clinical interview, administer psychometric testing where appropriate, and synthesize findings into a written report with clearly stated opinions and documented supporting data.

Earning Capacity Analysis

Employment Law

An earning capacity analysis provides a quantified determination of what a person could reasonably earn in the open labor market, both before and after injury, disability, or occupational disruption. It is routinely used in economic damages calculations in personal injury and family law proceedings.

Our analyses draw on Bureau of Labor Statistics data, California EDD labor market information, and where indicated, direct employer surveys. Methodology is documented and citable. Reports are written to withstand cross-examination by opposing economic experts and attorneys.

Case Law Reports

Workers' Comp

LeBoeuf reports are vocational appraisal documents required in California workers’ compensation cases to address an injured worker’s ability to return to modified or alternative work. Compliance with the LeBoeuf v. WCAB standard is essential for reports to be admissible and persuasive before a Workers’ Compensation judge.

Our LeBoeuf reports identify medically suitable occupational alternatives, document labor market access for those alternatives, and provide current wage data. Every report is organized to meet WCAB evidentiary standards.

SIBTF Reports

Workers' Comp
SIBTF Proceedings

The Subsequent Injuries Benefits Trust Fund (SIBTF) compensates workers who sustain a subsequent industrial injury that, combined with a prior disability, results in a total disability rating of 70% or higher. Many SIBTF claims require specialized vocational analysis addressing the combined impact of prior and subsequent disabilities on earning capacity.

Our Vocational SIBTF reports are prepared in accordance with Labor Code and WCAB standards. We provide clear analysis of the vocational impact of combined disabilities, documented to support eligibility determinations or to contest SIBTF claims.

What We Provide

06

Labor Market Surveys

Workers' Comp
Personal Injury
Long-Term Disability

A labor market survey documents the availability of suitable work within a claimant’s geographic area and physical restrictions. Surveys are a critical tool for establishing that identified occupations actually exist in sufficient numbers to represent realistic employment options.

Our surveys draw on current labor market data, published job postings, wage information, and occupational requirements to document availability, hiring conditions, and physical demands. Reports are structured to withstand opposing expert challenge regarding the quality and geographic relevance of the data.

What We Provide

07

ADA / Accommodation Analysis

Employment Law
Wrongful Termination
DFEH / EEOC

Reasonable accommodation disputes require a vocational expert who understands both the occupational demands of a specific job and the functional limitations of the individual seeking accommodation. Our ADA and FEHA analyses provide an independent vocational perspective on whether a proposed accommodation is reasonable and what alternatives may exist.

We review job descriptions, medical restrictions, accommodation requests, and the employer’s interactive process documentation. Our opinions address essential function determinations, accommodation feasibility, undue hardship factors, and comparative positions for reassignment consideration.
